My dad died two years ago and left a house with a mortgage. The deed was transferred into my sisters name but I've been living in it and we've both been making the payments. My dad's estate has been closed for over a year now but the mortgage is still in his name, "The Estate of" and their name is on the deed with my sisters. Now my sister wants her name off and wants me to take total ownership. Do we have to get the mortgage company's permission to transfer the deed to me? Who is really responsible for the mortgage now that my fathers estate is closed and it was never put into anyone Else's name? We are not behind in any payments.

Hi mjlong!

Welcome to forums!

You will have to contact a real estate attorney in order to get the property transferred in your name. Once the property is transferred in your name, you'll have to refinance the mortgage and pay off the dues on a regular basis to the mortgage company.
