my friends ex wife we have reason to beleive is going to flee the country to go back to her native country. she is a u.s. citizen. he has been paying the mortgage solely through the divorce and while divorce settled out(about 2 1/2 years). if she leaves the country --will this property be solely his. she wont sign a quit claim deed(does not play well with others!!!) her name is on the title/ mortgage of the house which is still currently for sale. what is the time line on this. we are in illinois

Your friend cannot claim to be the sole owner of the property unless his ex-wife transfers the property to him. I will suggest your friend to negotiate with his ex-wife and try to buy her out by paying certain sum of money and get the property transferred in his name. If she agrees to it, then your friend will become the sole owner of the property.
