I accidentally posted as a reply- I have been reading the posts and some say that a loan modification will relieve the ex from the loan liability, some say it wont. my ex has failed to meet the requirements as outlined in the decree by the deadline and extended deadlines...he is behind on payments and has not refinanced or prepped the house for sale as required... he was responsible for all expenses related to the house and wants to modify... but will it or will it NOT take me off the note if I cooperate with this? if it will not, I am going to request occupancy of the house and modify it myself. he is in contempt and the judge is seeing us on this matter.

Welcome Guest,

As far as I know, a loan modification will not remove you from the mortgage docs. Your ex will have to refinance or assume the loan in order to remove you from the mortgage.
