can I get a copy of a ladybird deed for my mothers house to mine name? I need a copy of ladybird deed or explain what it is?

A ladybird deed usually used to transfer property. But even after signing the ladybird deed the grantee will remain the owner until his death. A ladybird deed is a nick name of an enhanced life estate deed. It is a legal document using which you can transfer the property to your heirs name at the same time retaining a life estate along with the right to sell the property. This means that the person owns the property till the time he dies and can sell the property without notifying the beneficiaries. And after death the beneficiaries named on the deed will be able to take over the property without having to go through probate.

my mother and i bought a house together for her to live in. we want to avoid issues with my siblings so she quit claimed it to me. now taxes went up. if i grant a life estate back to her does that protect me legally as owner when she passes away?

You can add a life estate clause in your property deed and give your mother the rights to stay in the property. After she passes away, the life estate clause will become null and void and you will become the sole owner of the property.

mother is in a home on medicaid,i the son on deed @her death.can i rent her home out for my income,my lawer says medcaid will not allow it,is that right???? If his right,any way to do so, its just sitting...TKS

Medicaid can go for an estate recovery and may not allow you to rent your home. I don't think there is any way to rent the property.

Hi josephine,

As far as I know, ladybird deed is not used in North Carolina (NC). It is legal in Ohio, California, Florida, Texas, and Kansas.

my mother is in a nursing home and is on medicaid...she has a mortgage in which i and my small child live in the home...does the ladybird deed help me to stay in the home and continue to pay the mortgage..or is it true i have to leave the home bottom line

Your mother can use a ladybird deed in order to transfer the property to you. This won't make her ineligible for the Medicaid benefits. However, you will have to stay in the property and pay the mortgage dues on time.

my mother just resently passed away. My question is there are three sisters and a sister that is legally adopted where there is no birth certificate stating she is our sister. At the time of my mothers last days she aknowledged this daughter as hers in front of family members.we ourselves knew she was blood related. Does she have rights to our inheirtances. My oldest sister is named the only heir in the will

If the oldest sister is named in the will as the heir to the property, then she would be able to claim the whole property. None of the other sisters can claim ownership of the property.

I am facing putting my Mom in a nursing home. I have heard horror stories about nursing homes taking a person's bank account and having to sign over their homes. Would a ladybird deed keep the nursing home from taking the house?

Your mother can sign a ladybird deed and transfer the property to you. It won't affect your mother's chances of qualifying for Medicaid. Moreover, the nursing home cannot come after the property. However, you will have to stay in the property.
