after the passing of my husband it became very hard to keep the payments up I ask Home Eq servicing for a loan modification and they said I do not qualify because I am not on the loan just on the title. What can I do I am now 6 months behind please help

You won't be able to refinance the loan as your name is not on the mortgage docs. It would have been better if you would have refinanced the loan in your name after your husband's death. As you are 6 months behind on your mortgage payments, you won't be able to refinance. You can apply for a deed in lieu of foreclosure and get rid of the property. Your credit will not get affected due to this as your name is not mentioned in the mortgage docs. Then you can apply for new mortgage and purchase a property in your name.
