Hi there, I have gone through a divorce recently and have a Judgment of Separate Maintenance showing spouse wants the home and that I'm in no way responsible for the existing loan. I need to know if I can for a mortgage in such a situation if the new lender comes to know about this and that it is not a debt that I will be responsible for signed by a judge saying this?

Hi Jemima,

Though there is a letter which states that you are nor liable for the mortgage payments, the mortgage docs will still mention your name as a borrower unless your spouse refinances it in his name. So, it may be a bit difficult for you to qualify for a mortgage in this situation.

Under the circumstances, it would behoove you to insist that your spouse take the time and make the effort to refinance. Other lenders will certainly look at the mortgage as your continuing obligation, as Jerry noted.
