She is living in the property and refuses to sell or refinance and now I want to get out of this partnership so I can move on. What can I do?

The court will judge the whole situation and may order the sale of the property. Once the property is sold off, you will be out of this partnership. After the property is sold off, your mortgage would be paid off first.
