Under the fair credit reporting act, they can attempt to collect the debt. If you have provided your work information, they can contact you there. HOWEVER, if you tell them that you are not allowed to recieve personal calls at work, that these calls are interfering with your job, and you tell them to stop calling, and they don't, that is illegal.

It is very important to know your rights.
You can go onto the fair credit reporting agency's website to file a complaint against the company.
You should also write the company a letter and make a copy of it for your records.

I am in Maryland, but the law is a National Federal Law.

can we be of assistance helping you with your mortgage predicament?
Mortgage fit has a ton of lenders working here ..just to help.

Hi BROADCASTNT!

Welcome to forums!

I agree with Elnora that the lender has the right to contact you when you are at office and try to collect the debt. They also have the right to garnish wages if you are not paying the debts. However I would suggest you to follow Elnora's suggestion and ask the company to stop calling you or file a complaint against the company.

Feel free to ask if you have further queries.

No, NO, and NO. They do not have any right to garnish wages at all. That is a misinformation. Only the IRS have the means to apply for wage garnishments in the USA. There are other means of collecting debts which varies from state to state. I think the last thing to expect is for the credit report to be damaged, and turn in the or sell the loan to or transfer the loan to the collecting agency who will be attempting to get you and follow you whereever you go or live. However, you should know your right, because, you are very well protected against these people. There are lots of way out but the mortgage people or loan people would not want you to know....

"Only the IRS have the means to apply for wage garnishments in the USA."

HUH??????
niyifat2k1, you are adamant about this, yet you are absolutely incorrect. as a lender who has had to perform collections over the years, i know that if i sue someone and obtain a judgment and that someone fails to pay, i can go back to the court and request a wage garnishment, which they will honor. i can then hire a "process server" (not sure what they call themselves these days) who will take my paperwork to the debtor's employer and place the garnishment. i will then, eventually, get my money back.

how do you think most people in this country (us) pay child support? do you think they do it because they have cash laying around and like to write checks to former spouses or lovers? of course not...the vast majority of child support payments are collected by way of garnishment.

as for the last statement: "there are lots of way out but the mortgage people or loan people would not want you to know..." is ridiculous. all a creditor wants, once it has loaned money to someone, is to be repaid. that's as simple as it can be. every garnishment i ever needed was only as a result of someone's lack of paying according to a court order. and i can safely say that i'm happy NOT to be in the position of having to do collections any longer. it's an ugly job a lot of times, and nobody likes bill collectors, no matter how nice you are.
