Ok, the house was foreclosed and the redemption period ended and we were still in the house, due to the fact that we did not know and were NEVER notified by the bank. They filed an eviction motion with the court, but have since moved out of the property. Do we still need to go to the court date to put our answer on record? Or since we've moved out, is it done and over with? We are in Michigan.

If you've received a summons from the court, then you should give a reply to it. If you have moved out of the property, then you should write that as a part of your reply.

we have been renting home for 2 years house and it is in preforeclosure i just found out. Landlord hasnt told us anything, how long before it goes to auction ? I live in michigan and cant find any info.

Hi tracy,

The lender will let your landlord know about the date on which the property will go for a foreclosure sale. After the foreclosure sale is over, you would receive an eviction notice and you'll have to leave the property within that given period of time.

The house was sold in Sheriff sale the 4th of Aug 2010, there was no publication in the paper at all or not one posted on the home. Is there anything that can be done? Redemption period ends Feb 04, 2011

You can contact an attorney and take his opinion in this matter. He will look into your case and let you know whether or not you can take any legal actions against the lender.

I need to find a lawyer who will help us fight a foreclosure eviction. I have 4 children, one being severely handicapped and my income is based on a business run out of my house. I believe there are many reasons to fight this foreclosure sale and eviction, I just need to find an attorney.

Our redemption period ends July11, 11 and we have 2 kids. What is the next step. Can I stay in the same house by paying a rent, after approaching the lawyer? After redemption date how long can i stay

Welcome Guest,

It will depend upon the new owner whether or not he will allow you to rent the property. After the redemption date is over, you'll receive an eviction notice and you'll have to leave the property within that given period of time.

i received the court ordered eviction for thirtydays time. what happens then? does the sheriff put a notice on the door that you have to leave or does the date on the court document stand

Hi hhscafe,

You will have to leave the property within the 30 days time. If you don't leave, then the lender and the new owner of the property may take legal actions against you.
