Is my mom judgement proof?

My mom is in Michigan. Her home went into foreclosure. She has creditors coming after her. She has nothing. No assets at all. She has Social Security disability and a $450 monthly pension. She is living in a senior apartment. Her medication (MS) and 'just living' expenses take the rest of the money.

Can creditors take her SS Disability or pension? Can them go into her bank account to get the money? What can I do to protect her?

Welcome teammillar,

As far as I know, the creditors won't be able to take away your mother's SSD income or her pension. However, they may garnish her bank account if they receive a judgment from the court. If feasible, you may ask your mother to deposit her SSD check in your bank account.

Keep in mind that Social Security can go directly to a debit card and not into a bank account. That's a solution to the potential of a garnishment. You can check with the payor of the pension to see if that's a possibility with that income, as well.
