Ladybird deed in Michigan - Can state take away home?

MY sister and I are the deed to my parents home with my mother ,as a request of father when he past away in 1997. I want to know if we should sign off the deed and have my mother put a lady bird deed on the home,but I am worried that if she should go to a nursing home can the state of michigan take her home? Would it be just better to leave our names on the deed to protect it from the state.

Welcome Grego.

Your mother can use a Ladybird deed. But state law differs from one state to another. So check out with an attorney whether even after using a ladybird deed, your mother remains eligible for the Medicate facilities. Take a look at Ladybird deed and Medicaid to know more about it.

Hi maxine

You can use a quitclaim deed or a warranty deed as well to transfer your property in the name of your children. As far as ladybird deed is concerned, I think you can use it to transfer property to your children. To know more about ladybird deed, check out:

Hi bud,

As far as I know, a lady bird deed is acceptable in certian states like Florida, Texas, Ohio, California, and Kansas. I'm not sure if it is accepted in Michigan. I think you can get this information from any local real estate lawyer or the local county recorder's office.
