my husband and I are separating (live in Michigan). His name is on the mortgage not mine. If we divorce or they foreclose can they come after me for payment?

As long as you name is not on the original mortgage then they cannot come after you. Are you on the loan? If your on neither of them, then you should have no worries.

Hi kim!

Welcome to forums!

If your name is not on the mortgage, then the lender would not come after you for the deficient amount. As your husband's name is on the mortgage, he would be liable for the deficient amount and his credit score will get tarnished due to the foreclosure.

Feel free to ask if you have further queries.
