probate question

My father passed away about a year 2 years ago. The house is still in his name. We have been paying the taxes while we live in the home. There are 4 heirs including myself. 2 heirs have agreed to a payoff and want to sign off and be done with the whole process, the 3rd heir will remain on the deed with me until we pay him off in full. my question is; do we need a lawyer to go to probate and have the 2 heirs sign off the house and then have the deed put in my name and my brothers. Also, do we have to then apply then for a title to the home? I've heard it's very costly here in Michigan. Any and all information would be very helpful regarding this matter.

First of all, there is no denying the fact that you need to work with a real estate attorney to complete all those legalities. And regarding the legal costs, you cant help but to bear them, if you want to transfer the property in your name.

No, you don't need an Attorney - you can do the Probate yourself. My girlfriend did her Mom's Probate with the Suzy Orman Probate kit, and she saved a lot of money.

If the house is the only asset, you may be able to do an "affidavit of heirship" to transfer title to the heirs. You could then transfer between heirs as usual.
