My girlfriend lives in Michigan and has co ownership on a house and some land in another location with an old boyfriend. She wants to sell and move to NC but he will not do anything. He is a policeman and abusses his authority to scare her. What can she do?

Hi jeffgrove,

She can file a partition lawsuit in the court. The court will order the sale of the property. From the sale proceeds, the mortgage will be paid off first and rest of the amount will be divided amongst both of them. This will help her to sell off the property as well as remove her name from the property deed.

We just found out that her partner had changed the land to agricultural vs. residential in order to pay less taxes but she never knew about this nor did she ever give permission to make the change. Could this be a case of tax froud? Could she be liable for his actions? She called the tax office and the told her it was changed a month ago and he had a farmer plow up the land and plant soybeans. The value of the land went from $44,000 to $28,000.

Hi jeffgrove,

You need to consult a tax adviser to know if this can be considered as a tax fraud or not. However, if she is also one of the owners of the land, her ex should have informed her about the change of status of the land.
