My ex-wife is the co-signer on our house loan and I just found out she has filed bankruptcy in Missouri for her debts. Apparently, what she is doing might also be affecting me as well. I have paid all payments on the home is up-to-date on the mortgage. Is there any legal rights I have or can do to keep from my credit being hurt and not lose the home.?

Hi Guest,

You can keep the home provided you refinance the mortgage in your name. However, as your ex-wife had already filed bankruptcy, you won't be able refinance the mortgage in your name now. You will have to wait till the bankruptcy filing is discharged.

Thanks
