how to fill out the legal desciption part on Quick Claim

Hi, I have my Quick Claim Deed filled out except the Legal Description part. I live in St. Louis , MO and I am not sure how this part of the QCD needs to be done. I bought the QCD from Office Max . All parties have signed , it's Notorized, Witnesses ect have signed. Just need to put the legal description on the right way, and what else do I need when I file it?

Any help is appreceiated, and needed. Thank you....

Welcome James,

I think you should have given the legal description and then got the deed notarized. This is because the notary should sign the deed only when it consists of the entire details.

Hello James,

I am sending you a quitclaim deed form http://www.slpl.lib.mo.us/cco/ords/data/ord7404.htm of MO. You can refer to the exhibit A under which the Legal description is given and then make the changes required in the deed. I am really very surprised how the deed was notarized as it is only possible when all the details are complete in it. So I feel that you should consult your lawyer to check the validity of the deed and to take legal steps, if required.

Hi James,

The legal description is the most important part of the quitclaim form as it conveys the legal identity of the property. It should be added to the deed as an Exhibit. The county recorder will not accept the deed without the legal description. For the legal description part, you may go through any quitclaim deed form approved by your state laws.

Hi James,

Welcome to Mortgagefit discussion board.

I am also not sure how did the notary public notarized the deed when it is not yet completely filled out. He only notarizes the deed after all the details have been entered and signed by concerned parties.

IMO you should consult an attorney to know if the deed has been properly filled or not and also about entering legal description part in the deed.

Hi, thanks to all who responded. Jenkin 7 thanks for the link. I found my originall deed that has the info that was on the link you gave me. The QCD is for MO, is filled out with me being the grantee, my ex the grantor. I believe the Notart signed it due to knowing us both and we explained that I needed to know how to do the legal Description part and we both said it would be ok with us. Larry, how do I use the Legal Description as an Exhibit? Sorry for sounding so stupid! Just have never done this before.

Hi James,

In a quitclaim deed the legal descriptions can be used as an exhibit which includes a pictorial representation of the land being described and should be referenced as being conjoined as a permanent part of the legal description.

If you are transferring the same property interest you received as grantee, you can use the same legal description from the original deed. It can be part of the deed or attached as an exhibit. Check with the county recorder's office where the property is located to see about any requirements. At least, the exhibit should be marked, for instance, "Exhibit A", and should be referenced in the deed where the legal description should be, for instance, "See Exhibit A".

My husband & I lived in SC. We purchased Timeshare inst. John's county, St. Augustine , Fla. Recently we became legally seperated. I need a Quit Claim that will be signed in Summerville,SC county of Dorchester showing that my husband is transferring the deed to my name. Do you have a sample of a quit claim for South Carolina?
