Hi Mary and Emi,

Welcome to forums.

Mary, if you're dealing with payday loans, then paying $600 on $200 is not surprising because these loans come along with late fes and charges and god knows how the creditors manipulate and increase the charges! It's not easy to deal with these types of loans.

Emi, in your situation, I shall suggest that you call the representative for the last time and ask what's the total payment you need to make to get out o this loan. Just pay it off and stay out of this company. I've heard so many complaints till now and if you don't get away soon, who knows you might end paying thousands for just $200.

Thanks

It is time to shut these JERKS down.. they call my job constantly hanging up and not wanting to give information on what they are calling about. I am reporting them to the FTC and the AG for scams and harrassment.

Well that's a good thing that you're filing a complaint. These companies need to understand that they just can't go on doing frauds and illegal activities.

I received a call from this company saying they represent SJM and an unpaid balace I owe to them and would be arrested on Monday and go to court as they no longer wanted my money just to press charges against all the people who did not pay them. Well after I said I want to resolve he put me on hold and said he called the Attorney General (He didnt) Then came back and said I could pay $600 to resolve it and just fax him my debit card info. Well if they dont want my money why is he asking for it. Also they say they deposited money into my account on 6/2/2005 but thie account they say the money went to was closed on 5/20/2005. hmmmm. Also in may of 05 I paid a compnay by the name of Ellis Crosby who at the time represented SJM/Platnum B. I still have the money gram receipt to sho I paid it but this company says I still owe. what can I do? please give me you opinions on this.

Hi TIFFINIE.

If you think that you have paid the money to them then you should ask them to provide a debt validation letter.

I what they are doing with you is against the Fair Debt Collection Practice Act (FDCPA). So you can file a complaint to the state's Attorney General's office or FTC.

Hope that will help.

Best of luck,
Larry

Hi,

Ohh my God! They have threatened you to send jail? This is clearly against FDCPA or Fair Debt Collection Practices Act. You can even sue the debt collector for threatening you.

I think you should at least debt validation letter from the collection agency if you do not recognize the debt or think that you have paid the debt and have the proof.

Hope this helps. Keep us posted.

Best of luck,
Larry

Ok I just spoke to Ms. Sunshine again and asked for the name and address of the company so I could send/receive a debt validation letter. She screamed something at me that was not understandable due to her lack of English. I should say that she called my phone 6 times in 20 minutes and left messages like I'm calling your manager at work, etc. prior to me reaching her.

So I repeated myself and explained that I was in the process of obtaining my bank records to either prove or disprove that this was a valid debt. Again more yelling. SO I told her I was recording everything and to stop threatining me and that I saved her voicemail messages. She told me I'll show you a taste of the real world and hung up on me! lol You cant make this stuff up! So I suppose I wait for a letter???

Welcome Michele.

Why don't file a complaint against the debt collector as they are threatening you. I fell you should a file a complaint against the company in the Attorney General's office in your state as soon as possible. They have no right to threat any clients for collecting the debt.

Keep us posted and let us know about your situation Smile

It really pisses me off when someone/or a company rips people off. Have they no scrupples? When I first made the loan, I told them to take the whole amount out. They told me, I had to call them two days prior to the withdrawal. When I contacted them, no one answered the phone. No matter what time of day I call, no one answers the phone. I have to believe that there isn't really anyone there. The number is just a front. I am so glad that someone got a number for the company. I wasn't given that number. Wonder why no one contacted me back. I hope this number works.

The nerve that the company would try to put innocent people in jail. They should go to jail. What they are doing should be illegal. I am going to close my account and open another one. The problem with that is that I have some automatic withdrawals that come out of that account and direct deposits as well. Dang, this really gets me fueled.

There should be a law against this type of thing...I mean, its like a "supposedly" legal way of robbing good people. How can we put a stop to this? If you have a suggestion, I would like to know. Companies shouldn't be allowed to do this type of thing. They just shouldn't.

Welcome Guest.

This is certainly illegal. You can file complaint against them with the FTC or Attorney General's Office in you state so that the necessary legal action can be taken against SJM Marketing.

Let me know if you have further queries.

PostPosted: Mon Aug 11, 2008 7:49 am    Post subject: Developments on SJM/Asland Funding/iCollect/Spellman & R

I began receiving threatening phone calls from a company calling themselves "Spellman and Roman". They threatened my mother in law, my work, saying they would cause a "disturbance" there and get me fired and then the final straw was the following: A woman by the name of D.C. Miller called and said I had to pay $1486.10 in 20 minutes "or else". I asked what she meant by that and she said "well, let's put it this way...I know I'm going home tonight, but you'll never even make it home". I asked if that was a threat on my life, and her response was "take it however you want". I immediately drove to the police station and filed a complaint statement with them. This woman called again while I was at the police station filling out the forms, so I tried to pass my cell phone to the officer assisting me, and she hung up on him. (He identified himself as an officer and she called him a "liar" and disconnected.)
I researched the FDCPA, and these people have violated 16 articles in it...even if you let them know that you are aware their actions are illegal; they don't care...they just keep harrassing and threatening.
They refuse to provide any documentation, but in one phone call I managed to get them to slip up and give me the original creditor's name which they said was "Ashland Funding". I searched online and found a phone number for them of 1-866-722-2770, and called it. They said they had my name on file, but that they had "sold" my debt to a company called iCollect, and to call them. iCollect's phone number is 1-866-856-1024, and when I called, I am unable to reach any live person; it is just a recorded message saying you should contact the original creditor if it is less than 90 days old, or contact the collection agency that is calling you if it is over 90 days old. No other phone numbers are provided, no address, nothing!
As for the actions of "Spellman & Roman" (which I have researched, and have gone by all of these names: State Predisposition, Jacksonville Law, Offices of Winston Law, Offices of Sydney Roman, Offices of D.C. Miller and Spellman and Roman...all withing the last 6 months, so there's a BIG red flag there!), I have begun filing complaints with anyone and everyone. I filed complaints/statements with my local law enforcement, FBI fraud division, FTC, State Attorney General for both Florida (their original base) and South Carolina (although their address there is fraudulent and comes up as an empty warehouse), homeland security financial division, BBB. They insist that the only way you can pay the debt is to deposit cash into a bank account at Bank of America, so I took that account number with me to B of A and notified them that someone was illegally trying to extort money from me throught their financial institution. The had me fill out statements for the Corporate Securities department.
Anyone wanting to ask more information from me on this, please feel free to contact me at "myessentiajewels@aol.com" as I am happy to help anyone avoid the nightmare I am going through with these people.

Welcome Guest.

You have done it right by filing complaints with FTC and State Attorney General's office in your state. They don’t have any right to threaten and harass you. By the way you can also demand debt validation if they call you further.
