National tenant refers to a lessee who has earned reputation in the United States. Such tenants have better credit profiles compared to the local tenants.
The laws regarding the rights of national tenants and responsibilities of landlords vary from one state to another. Some of the legal aspects of a lease in the state of California are provided below:
- A landlord should not discriminate against a tenant on account of the latter's race, color, religion, income source or disability.
- The landlord should provide the tenant with a written translation of the lease or rental contract in the language used for negotiation before the tenant signs it. But this rule is not followed if the lease is to last for one month or less.
- A landlord can enter a rental unit only under specific conditions and during specific hours on week days. But he must notify in advance, the date, time and purpose of entry.
- A tenant can file a lawsuit against the landlord in order to recover money damages. This is often done when the landlord does not repair defects in the rental units.
A landlord cannot influence the tenant to vacate the property by doing the following:
- Getting involved in theft or extortion.
- Using threats, force or negative conduct.
- Violating the rules and regulations for entry into the rental unit.
When a tenant leaves the property, the landlord must send within 21 days:
- An entire refund of the tenant's security deposit.
- The landlord may also mail the itemized statement mentioning the deductions from the tenant's security deposit, and the reasons for the deductions. He should also send the tenant a refund of the amounts not deducted.
