My husband recently died in Las Vegas, NV. The mortgage was in his name only. Both of our names are on the deed. I am unable to keep the payments on my own. I know I am not responsible for the mortgage, but what do I do about the deed? Also, the house is underwater as far as the mortgage goes. Is there any chance that they might modify the loan at the current housing prices so that I can stay in it or should I just let it foreclose and move on?

Hi lawgregory!

Welcome to forums!

As your name is not on the loan docs, it would be difficult for you to get a loan modification. Nevertheless, you should contact the lender and apply for it and check out if the lender considers your situation to give you a mortgage modification. In case, the lender does not agree to your request, then you may let the lender foreclose the property.

Feel free to ask if you've further queries.
