I'm looking to file for divorce . I was married in the Philippines in 1996. I've been "separated" since 2004. I moved to NJ in2006. My spouse still currently lives in the Philppines We have 1 son, and he never paid child support, as he's unemployed all these years. However, I bought a condominium last year here in NJ, which he doesn't have any part of. If I file for divorce now, will he have part of the condo equity or my retirement plan? I know he won't sign a quitclaim. Please help.

Hi Vivian,

As the property located in New Jersey is solely in your name, your husband will not be able to claim in that property or claim a portion of your retirement plan.
