My dad died and his deed to his home in nj is tenants in common with his present wife. he has left everything to me and my sister. We want to remove his name from the deed and add mine and my sisters to it. He has left his wife with a life estate. What form do I file and can we file it on our own with the courts without using a lawyer?

Hi Guest,

If your father has left a will, then you need to contact an attorney and get the will probated. This will help you in removing your father's name from the deed and let you add your name to the deed. If there is no will, then you and your sister will have to file an affidavit of heirship and add your name to the property deed.

A deed or title is what determines who owns real property, so the answer would be no. However, it is extremely important for any property owner to be certain the title or deed is worded to their best advantage under the laws of the state where the property is located. Jointly owned property when not held by a married couple should, whenever possible, be titled Joint Tenants With The Right to Survivorship, (JTWRS).
