Hello
I am thinking on getting a quit claim deed to remove my husband from title. I live in NJ which is a spousal state and I am unsure how valid a quit claim deed is.
I am going to refinance with the intention of doing a divorce buyout. however I do not want to file for divorce right now. just want to have a quit claim deed done pending a seperation agreement indifinately.
I would like to know if I my husband will still need to sign the mortgage at closing if he signed a Quit claim deed giving up ownership to the property?

Hi Pat,

You can ask your husband to sign an interspousal transfer deed in order to give up his claims on the property. Once he does so, he will not have to sign any mortgage documents while you refinance the loan.

Since NJ is a spousal state, quit claim deed will not help you. you use interspousal transfer deed for this purpose. also infom to mortgage lender about this settlement
