In NC a couple has to be leagally separated for a year before filing for divorce and live in separate households. My husband won't leave so I am moving out. We have only been in our home for 2 years, so obviously still have a mortgage. If we sign a quit claim deed, will that release me from any obligation to that loan?

Hi DARLA!

Welcome to forums!

Signing a quit claim deed will not release you from the mortgage obligation. It'll only remove your name from the property deed. Your husband will have to refinance the loan in his name in order to remove your name from the mortgage.

Hi Darla,

In order to remove your name from the mortgage loan your husband needs to re-finance the loan in his name. However, it has to be approved by the lender. Speak to your lender regarding this, consult with an attorney and check your divorce decree carefully, then take necessary action.
