Hi. My ex-fiancee is deceased. he willed his half of our income property to his new wife. It's been a year, and she has not probated his will...stating she has no money to do so. Can i have his name removed from the deed and sell the property? Note: I have never seen a will. Only heard that there is one.

As there is a will, unless it is probated, the property cannot be owned by you. Unless you own the property, you won't be able to sell it off.
