my sister died, no children or spouse, only sisters and brothers. Can the deed on her house be transferred to one of us?...There is a mortage on the home. We live in North Carolina. Is a deed of Trust.

Hi matlewis,

If the other siblings have no objection, then the property can be transferred to anyone of you. The person who wants to get the property will have to file an affidavit of heirship at the county recorder's office and transfer the property in his/her name. Then that person can refinance the loan in his/her name.
