Properties in an L.L.C., 3 members, mother, father and son. Most recent property owned for more than 4 years. Son married in 2008 and now considering dissolution of marriage. How do dower rights come into play in this case?

Dower rights are the rights that a non-owner spouse has in the real estate property of his or her spouse. If dower rights are applicable in your state, then your wife will be able to claim dower rights in that property.

My son is getting a dissolution and his name is not on the mortgage. His spouse purchased the home before marriage 5 years ago, but she refinanced a year ago. My son wants to purchase the home which the wife wants to make a profit from since she put $8,000 down payment when she purchased it. My son has made the mortage payments for the past 5years. Exactly what is "dower rights" and does his wife have any right to recoup her down payment?

Welcome to forums!

As far as the dower rights are concerned, it will be better if your son could consult a lawyer and take his opinion in this matter. If the wife is the sole owner of the property, then she can claim a profit and sell the property for any amount that she wants. There won't be anything wrong in that.
