I am getting married to a gentleman who owns a condo and who has 16 yr old son. I am leaving my 100k job to marry him and afraid to ask him to include me in his property as I do not want to come across as a gold digger. However, in case of his death, can his ex wife kick me out from the condo as his son will be his heir or our registered marriage(in ohio) will change that picture? Concerned in ohio

Hi kalpana,

After your registered marriage you will be his legal wife and thus will have a right to the property. However, it's always better to ask your husband to add you to the title of the house or go for a joint tenancy. He can also prepare a will, giving each one a fair share in the property upon his death.

Hi kalpana,

Whether you will have a share in the property after your marriage depends on which state you live in. If it's a community property state, then you'll get half the property after marriage. But if it's not, then I'm not sure whether you'll get any share, unless you're added to the title. Thus, it's better to consult a real estate attorney and see what he/she has to say about it.
