My Dad who lives in Ohio purchased a home back in the 80s. His live in girfriend's (at that time) name is also on the deed. When she signed the deed she used my dad's last name although they were not married. They broke up about 18 years ago and she moved out. During this 18 year time period, my dad has made all repairs to the house and paid all mortgage payments and property taxes. The house has been paid off for more than 10 years now. My dad is elderly now and in ill health and has had to move into an apartment because he cannot afford to renovate the home so that it can accommodate his physical impairments without taking out a loan. This woman has done nothing to keep up the home, what recourse does my dad have?

Hi Butterfly,

If your dad's girlfriend is willing to quit claim her share in the property then the ownership of the whole property comes to your dad. For this, I think, you need to contact this lady first.

If she has got her name on the mortgage also, then your dad needs to refinance it in his name only.

Hi Butterfly,

I would like to know whether this woman's name was there in the mortgage also.

If you or your father ask her to compensate for the property at that time (18 years ago), it may help the condition but now I don't think she will give anything to renovate the house. You can only ask her to quitclaim the deed to your father's name so that your father can own the whole property.

Ok, I would like to ask you another question. Have your father made something like Medicaid as you have said he is in ill health?
