Survivorship Deed

We live in Ohio and are buying a new house. I told them I want a survivorship deed. They said, don't worry, they all have both husband and wife names on them theses days. Does having both names insure that it is a survivorship deed? If not, how do I insure they create the deed with the correct wording?

Hi sandrasandy!

Welcome to forums!

Mentioning the names of both husband and wife on the property deed does not make it a survivorship deed. Joint tenancy with rights of survivorship should be clearly mentioned on the deed. You need to contact an attorney and he will help you in drafting the property deed with proper wording.

well, I was trying to get it written that way to start with. Since the bank surely has a lawyer, I don't see why they can't write it correctly without me having to go and have their work redone. Is that an unreasonable request on my part to have them write it as survivorship deed?

If the Bank left the Survivorship wording off my property deed shouldn't they be responsible for correcting it? Why should I have to go through an atty. for their mistake to have one redone?

Hi Gina,

If it's the bank's fault, then the bank should rectify it. You can contact a real estate attorney and take his help in asking the bank to correct the deed.
