| I owned a home with soon to be ex-husand. Mortgage and deed in our names. I signed POA to have my name removed from deed and ex-husband was to refinance the mortage and pay me an alloted amount of money. This is all signed in a marriage settlement agreement, also had to do all of this within 90 days. 90 days pass and we find out ex-husband is selling home to family member because he could not get a loan to re-finance. He is going to closing within days and lawyers are going to try to place a lien on the property because 90 days has passed and he has made no attempt to pay me the amount agreed to. Will this work or what should I be doing different. Thank you for any help/ideas/suggestions |

Hi Guest,
As 90 days have passed and your husband has not taken steps to pay you the agreed amount, it is a good option to place a lien on the property. You should ask your lawyer to take swift action in regards to placing a lien. The lien should be placed on the property before your ex-husband transfers it to someone else.

certainly a lien would protect you. it would seem, from the impending sale of the home, that your husband is striving to meet the terms of your agreement. unable to obtain a refinance, i'd think the only way in which he'd be able to obtain the needed funds would be a sale. _________________ George M.
