We purchased a home and have been living here for one week. We had a full day of rain today and now we have a puddle in the basement storage room, and another leak in the basement bathroom.

On our disclosure statement from the previous homeowner they marked the box saying that there was no water or leaks in the basement. Our inspection noted a draining issue outside in the same corner where the two leaks appear to come from. We were told that the home owner would take care of this issue.

Do we have any legal right to have the previous homeowner fix the problem? As I said before we have only been here one week! Where would you suggest we begin the process to have this issue resolved?

Thanks ahead of time for your thoughts!

Hi nm,

As you were told that the previous home owner will be taking care of this leakage issue, you can ask the previous owner to take care of the issue. Whether or not you have a legal right is something that your attorney will decide. You should contact your attorney and check out what legal actions can be taken against them. He will be able to assist you better in this matter.
