How long do I wait to buy home after chapter 13 dismissal?

with a bankruptcy on your record at all, it's not easy. with one that has just been discharged, that'll make it more difficult. however, having completed your chapter 13, you ought to be able to find someone to assist you.

ITS BEEN 2YEARS SINCE MY CHAPTER13 WAS DISMISSED. NOW I AM GETTING LETTERS FROM COLLECTION AGENCIES . STATING THAT I OWE THE FULL AMOUNT OF ACCOUNTS TTHAT WERE NOT FULLY PAID OFF WHEN MY CHAPTER 13 WAS DISMISSED. DO I HAVE TO PAY THEM.

Hi BERT!

Welcome to forums!

If the debts had been discharged in your Chapter 13 bankruptcy filing, then the collection agency cannot harass you for the payments. You must have the documents related to the discharge of debts in bankruptcy. You must inform the collection agency about it and even send a duplicate copy of those documents to the collection agency.

If the collection agency still harasses you, then you can contact your bankruptcy attorney and take necessary steps against them.

here's the key: bert, you said your chapter 13 case was dismissed, and you didn't say it was discharged.

that leads me to believe you still owe all the debts that would have been included in the bankruptcy had your filing been carried to fruition.

what's the real deal?

I have filed for a Chapter 13 bankruptcy on Sept of '07 and volunteered to get it dismissed on Feb of '08. I had no means to pay for my mortgage at the time. Right now, my house should be in a process of a short sale. Just to avoid forclosure. I'm trying to build my credit up and also looking for a job. Now do I have to disclose that information when applying for a job? Saying that I've filed for bankruptcy even though the bankruptcy was dismissed?

i don't see any reason to divulge the bankruptcy, unless there are questions asked concerning your financial status, or if you are looking for a job in a bank, for example. clearly, a person's credit background is part of the employment screening process these days, and you can anticipate that the prospective employer(s) you speak with will be pulling your credit report. don't worry - it won't ding your credit score when they do it. it might not hurt to you to be upfront about your credit situation.

I want to stop my bk13 and try to get back on track with my creditors.my bk13 is taking 700 a month from my check I figure if I took the 700 a month and made payments on the most pressing i probably would be fine.I want to find out how to go about contacting my creditors to see if they can take off the fees and let me pay what i owe.

Welcome to forums!

You will have to get your bankruptcy dismissed if you're planning to negotiate with your creditors. They won't be ready to deal with you unless you're discharged of bankruptcy. You will have to speak to your bankruptcy attorney and take his opinion in this regard. He will be able to let you know how you could dismiss your bankruptcy filing.

i am applying for an FHA loan but last year I took a forbearance on my mortgage and it looks like i was late 3 times 90 days plus and the last month being August. Will my loan be approved if they pull my credit in September since it has been a year?

FHA approved lenders will look into your credit report before giving you a mortgage and check out the negative items that you've in your report for the last 1 year. It will be the lender's discretion whether or not he would approve you for a loan.

My trustee is fighting us because of utilities and insurance he says is to high and day care he basically wants us to pay 10% to our creditors but we are filing a chapter 7. What should we do?
