Our trustee send us a dismissal from bankruptcy. Does it mean that my husband's check will not be garnished? We were dismissed for not sending him the copies of our tax return. The trustee actually informed us that we could send him the return within a few weeks but then we received a dismissal notice from the court.

I think you need to refile the bankruptcy.

Hi Bellinda,

Welcome to the forum.

You have actually filed without legal representation. This is known as "Pro Se". I guess you may have done this just because an attorney has informed you to submit the copies of your tax returns 7 days prior to the meeting held by your creditors.

As a debtor, you should submit the pay stubs for the last 2 months of service along with the copies of last year's tax returns. You may also have to send in the last 6 months to 2 years of bank statements, 6 months of pay stubs and tax return copies for the past 2 years.

Hi Bellinda,

Since your filing is dismissed, you may lose the protections which are offered to those filing first.

If you are subjected to wage garnishment order before filing for the first time, you may not be able to stop the order if you file for the next time. And, until and unless you receive a discharge, your wages may be subject to garnishment. I personally feel that you will have to file again. Its best to consult a bankruptcy attorney before you refile.
