You must know that by DIL you will lose your house. Have you explored other options to have your mortgage modified? How is the market in your area? You can look to sell the house and pay off the loan as a deed in lieu will affect your credit score. If the houses are not selling in your locality then lender might not agree to accept the house through a deed in lieu.
