Can an owner draw up an unrecorded mortgage for someone without paying his bank off first? is this fraud?

This guy didnt tell his bank or insurance company. I have been making the payments a 6% interest..it is not recorded anywhere. I also had to pay the property taxes to HIM and the insurance, which I am not on by the way, it is in his name like he lives there. I put $12K down and now I think he just wants to defraud me. Im not even on the house deed anywhere and I suspect that his bank doesnt know he doesnt live there. What should I do next? He is threathening to sell the house as I am making waves by asking to see my payments applied. He put an ad on craigs list for the house offering "owner financing" thanks

Is the mortgage note you signed with him notarized?

/yes it is..but it is unrecorded per his insistance. He also did not tell his insurance company it is not owner occupied. I paid the insurance and taxes to him per his insistance also. I dont want to be part of any fraud. I want out of the deal and my money back, he initially told me it was owned free and clear

how deep into this are you, marge? did this just occur? if so, you've got a chance, i suppose, of getting your money back. if it's been a while, i don't know how you'll resolve it.

have you retained legal counsel? that's essential in a case like this. i don't like the sound of what you got yourself into, and i certainly think you ought to bail out if possible and try to get your money back asap.

He is trying to extort me for money, he is telling me if I dont refinish his hardwood floors (there is one dollar size spot on the edge of the floor from the tile to the hardwood) replace the carpet with HARDWOOD when if I leave, he will sue me for leaving and "damaging" his house. The house was built in 1985 and it is all builders grade stuff. He gave me permission to refinish the garage into a family room at my cost, he also wants that converted back to a garage at my expense if I leave, but I have emails that it "looked really great" now he says it devalued his house. How do I get out without being sued? I want to call a fraud line on him. He wants me to pay him money if I move out, but I dont think I can stay and be safe with this deal..Do you?? He also left personal property as part of the deal, a 32' TV with a huge back on it..well the picture went out and I set it on the curb, now he wants me to pay $2800 for the TV when they are on craigslist for $150. He is a sweetheart! He also told everybody "I stole the TV" when I actually put it on the curb as it was broken.

sounds like he's just trying to harass you to the point where you give up and get out so he can do it all over again to the next person.

If you able I would call up an attorney and scare him right back with a letter from an attorney..

sunny, continue reading some of the posts on here and you'll discover that it happens constantly. there are so many of the "i can't afford a lawyer" category that it's sad.

either those who do this are unbelievably strong in their belief that human behavior is benign, or they are simply not sophisticated enough to understand that there are those who'll cheat them out of everything they have if possible.

it's almost an epidemic, i think.
