MERS, Countrywide, Heritage and BOA? Who has rights?

The standard Fannie Mae and Freddie Mac MULTISTATE NOTE has a paragraph 10 which indicates that in some jurisdictions a MORTGAGE exists to protect the NOTE HOLDER in case someone does pay as required per the NOTE. Andy in SW Florida Guest	Posted: Mon Dec 20, 2010 1:57 pm    Post subject: BOA Crap Like 0 Dislike 0 After 11 months, BOA offered me a HAMP mod that was only $60 less than original payment. In the "Terms" of that mod,they have a stipulation where by accepting this modification, you agree to not question the original note. Not exact verbage but, it was close to that.
