Neither of you as a married couple may have owned a primary home in the past three years.
If you refinanced and you are on the mortgage you must be on the deed. You can not be on the mortgage and not o the deed unless you were just signing the mortgage to give up your rights in the event of foreclsosure--in that case you signed the mortgage but not the note and you may still not be on the deed.
Anyway, you are married and one of you owned a primary home. Neither of of you are eligible for the tax credit. _________________ John Veenstra
