My husband and I married in 2007. He purchased our home before we got married. I was never on the deed. I have never purchased a home, but we refinanced our existing home with me on the loan this July, essentially making me a buyer. Would I qualify for the tax credit? Could anyone help?

Neither of you as a married couple may have owned a primary home in the past three years.

If you refinanced and you are on the mortgage you must be on the deed. You can not be on the mortgage and not o the deed unless you were just signing the mortgage to give up your rights in the event of foreclsosure--in that case you signed the mortgage but not the note and you may still not be on the deed.

Anyway, you are married and one of you owned a primary home. Neither of of you are eligible for the tax credit.
