My friend got a foreclosure notification, they worked out with Suntrust a loan modification where she was suppose to make $500 a month pmt. When she sent the first pmt and second both payments were returned bank did not wanted to honor loan modification on August 24, 2010 she went to court and the judge had the attorney for the lender on the phone and she ordered him to get in contact with my friend and work out a plan for repayment, the attorney nor the lender ever contacted them and it has been since then that they have not heard anything. She filed with the court/judge a motion of default for Suntrust, the lender have not responded or contacted them this was done on 3/28/2011. They would like to know if they can file for judgement in their favor and have the mortgage debt waived off and close the case. My friend is 70 yrs. old. Only income Social Security.

It will be better if you could ask your friend to contact an attorney and take the attorney's opinion in this matter. The attorney will guide your friend and let her know whether or not she will be able to take any legal actions against the lender.
