My husband and I purchased a home almost 30 years ago and put it in trust in 2003. We refinanced the home prior to that. He has died and I am the trustee of the trust. I have paid the mortgage since his death. If I ask the mortgage company to put my SS# on the 1098 will they do that or must I refinance? Both our names are on the mortgage.

Hi lsgade,

In order to remove a deceased person from the mortgage docs, you will have to refinance the loan. In order to do so, you will have to remove it from your trust in order to refinance the mortgage.

You have to refinance your mortgage and follow necessary procedures to settle your loan without your husband's name.
