reclaiming propertywhen neighbour moves

There is an old fence that has been on my property for 34 year which is 3 feet on my side. I want to take it down and put up a new one on the property line were I have established by getting a professional survey done. My neighbour is telling me that the fense is the property line. When my neighbour sells their property can I then move the fense to prevent problems or can the new neighbour claim adverse possession. I have beeen living at my resident for 4.5 years.
if you have the proper maps available and the exact demarkation of the property the n it will be surely possible for you in the court that you have all the legal rights to safeguard your property.

If you know the the exact distances from every direction of your property then it won't be a dispute anymore. but try to resolve this matter in front of government officials so you don't have to face any nightmare in coming future. :arrow:

Hi Maclean,

I don't think the new owner of the property will be able to claim adverse possession immediately after he owns the property. In order to claim adverse possession, the owner will have to own the property for a certain period of time and pay taxes for it. But I would still suggest you to contact your present neighbor and clear off the issue.

Hi there, I think i know the answer to this one.....when they sell the house and the surveyor comes out he will set the little flag where the property line ends. If you're correct you don't have to worry about a thing because it's a moot point....property line is over there, fence is over here, your fence to do with as you please....period.
