my wifes and my name are on the deed. but the home loan is in her name. does she have to include my income also when applying for a modification

If you are not on the loan, then you do not have to list anything that you dont wish to disclose. The added income could help you get qualified and it can also hurt your chances. Mods are really dependent on the bank and if they will make more money by modifying your loan. There really is not guidelines that the industry is to adhere to. You can resubmit your application if denied. Try and try and try again. Document ever call, record them if you can. The more documentation you have, the better. Good Luck!

Welcome to forums!

Your wife is the sole borrower of the loan. In such a situation, your income won't have to be included when she applies for a loan modification.
