MY PARTNER IS CO OWNER TO MY HOME. SHE ABANDONED THE PROPERTY AND THE RELATIONSHIP SIX MONTHS AGO AND MOVED OUT OF STATE, I LIVE ON A FIXED INCOME, AND I COULD NOT PAY THE MORGAGE BY MY SELF. I RENTED A ROOM TO PAY THE CO'OWNERS SHARE. THE EX PARTNER IS NOT HAPPY BECAUSE SHE WANTED ME TO FALL BE HIND AND MOVED OUT OF STATE WITH HER. NOW SHE WANTS TO COME BACK IN A CAUSE PROBLEMS FOR ME AND MY RENTER . SHE HAS NOT PAYED HER SHARE OF THE MORGAGE IN SIX MONTHS. WE ARE NOT MARRIED . I HAVE CHANGED THE LOCKS AND HAS MOVED ON. THE CO OWNER WILL NOT GIVE A QUIT CLAIM.

Hi Guest,

You and your partner are co-owners of the property. It means both of you have ownership rights to the property. Thus, you cannot stop her if she wants to come back. Until she quitclaims, she can claim her interest in the property.

Do you have some sort of agreement or written document which proves she is liable to pay her share of the mortgage payments? If you have, then you can take legal action against her and force her to make the partial mortgage payment. But if the agreement was verbal, I'm afraid you do not have any right to force her to pay her share of the payments.
