can collection agency garnish my ssi check i am legal blind

I just got a summons and complaint today from a hospital i had to admitted like 3 yrs ago and it cost 18,000 and all i have for income is my SSI i'm in michigan and i didn't know if they coulld take it from i have direct deposit but its a prepaid card i just don't know what to do i only bring in 674 a month and i told them before i couldn't pay all my money goes for living expenses and food i even still live with my mom this is scary for me it's the first time anything like this has happened i just want to know what i should do thank you

Hi Devonna,

The collection agency will not be able to garnish your social security income checks. However, if it gets deposited in your checking account, then the collection agency can garnish the money from that account. However, in order to do so, they will have to file a lawsuit and get a judgment against you. Unless they get a judgment against you, they won't be able to garnish your account. You should reply to the summons and also negotiate with the collection agency and try to pay off the dues.

Collection agencies CAN attach your SSI payments as this is happening to my daughter in law, they went in and took $200 and have demanded $200 per month or she will be sued. I thought this was illegal but apparently not...just a heads up to anyone who thinks they are exempt.

i went to the to take money out and find out to my surprise that my money was gone.a collection agency from another state put a subponea and restriction order on my ssi account. i was never serve any papers from that state.is these legal why the bank gave my money without consulting me.

Hi mercedes,

Unless you're served with papers and the collection agency gets a judgment against you, they can't garnish your Social Security income. You should contact an attorney and check out what legal actions you can take against them.

If I were you I would look up 15USC 1692e-g

It's part of the fair debt collections practices act and from what I'm aware of, my sister is disabled. She's judgment exempt.

There's a lot of different routes you can take here. In most of these cases I would suggest disputing these things. Mercedes - You should talk to a lawyer. That's ridiculous.

i owe child support from 20 years ago. since i have become permantly disabled since the 2000. the state of california has been taking 40.00 a month from me. can they?

Your social security income cannot be garnished. You should contact an attorney and he/she can better guide you in this matter.

Mercedes, concerning your loss of funds from your account. There had to have been a judgment issued at some point requiring you to repay a debt that had, presumably, fallen into default. Your failure to pay such a debt would enable the lender or its representative (such as collection agency) to go back to the court with a request for a garnishment.

Upon receiving approval for that request from the court, if they knew or found out where you deposit your funds, they could then send a sheriff (or some other appropriate official, depending your location) to the bank or other financial institution where your funds were sitting, and the bank would be required to hand over the sum requested. You would not be entitled to prior notice other than the one you would have received when the court action commenced.

Believe me, I know it's an ugly thing to have a creditor take your funds out of the bank. I feel your pain.

I'm on SSI, can a collection agency take a small debt I have, from my bank account..This small debt is over 10 years old, and under 500.00

Hi JANICE!

Welcome to forums!

If the debt account has crossed the SOL period, then the collection agency won't be able to take any legal actions against you in order to garnish your savings account. Moreover, SSI income can't be garnished by anyone.
