my 20 year old college student daughter co signed a 4000.00 loan for a now x boyfriend, he is now not paying the loan...she is a college student works part time and has no money...what are her rights and what right does a bank have letting her co sign, being a student w/ a part time job?

Hi spoiledasiam,

Your daughter can co-sign the loan if she has a good credit score. It is not the bank's fault that her ex-boyfriend is not paying the loan. As your daughter has co-signed for the loan, the lender can come after her in order to recover the dues. If she is unable to do so, the lender will foreclose the property which will have a negative affect on her credit report.

what happens to the x boyfriend since he is not paying the loan..? if she pays the loan does he still get credit for it being paid, like it will have no negative effect on his credit but if she doesn't pay then she gets negative credit...? he also demolished her 3000.00 motorcycle...what can be done about that? she did not have collision or comprehension on the mortorcycle..? guess she is out that too....whyis it legal for the losers to get away scott free and the givers serve the price...?

Welcome to forums!

The girlfriend should have asked the boyfriend to refinance the mortgage in his name. If he had refinanced the mortgage, then the girlfriend would have been released from the mortgage payments and the delinquent mortgage payments wouldn't have affected her.

my daughter(the girlfriend) was told at the signing of the loan application that in 6 months he could get his own loan..well since he is delinquent, she cannot be released from the load...it is not a mortgage payment , it is a personal loan for which he bought a car and then demolished.

The boyfriend has to refinance the mortgage in his name in order to remove your daughter from the mortgage. Unless the boyfriend does so, your daughter won't be able to remove her name from the loan.

Hi richard,

You should persuade him to pay off the student loans. If he does not do so, then you will be liable for paying it as you had co-signed for the loan.
