deed in lieu

When is it too late to request a deed in lieu? We have a court date for a foreclosure hearing in 5 weeks.
Hi Losnider,

It would have been better if you could have applied for deed in lieu before the date of foreclosure hearing was announced. I would suggest you to contact your lender immediately and apply for a deed in lieu of foreclosure. It would be the lender's discretion whether or not he would accept the request now.

You can still apply for a deed in lieu. It would have been better if you would have applied for it as soon as you became delinquent on your mortgage payments. However, you should note that it is the lender who would decide whether he would accept your request or not.
You can write a hardship letter to the lender and if the lender accepts it, you will know what steps you needs to take.

Welcome to forum

Most of the lenders decide the deed in lieu request on the basis of capacity of the borrower as well as past payment history. So, if you think that you have a very good payment history of couple of years then bank may accept your deed in lieu request.
