fraudulently obtained mortgage

My brother forged my mother's signature on a power of attorney and then took out a mortgage on her home. If she told the mortgage company of this fraud, would she still be responsible for the mortgage or would the property revert back to her?

Your mother can consult an attorney and file a lawsuit against your brother. If her lawyer can prove this fraudulent act in the court, then the property would be reverted back to her. As far as the loan is concerned, it would be the court's decision as to whether or not she would be liable for it.

simply informing the lender isn't going to work. as james has noted, your mom will need to engage the services of an attorney to straighten this mess out.

she would not be liable for a fraudulent transaction, but she must act in order to protect herself.
