HomeOwners Association is suing me.my Wife. Tenanat One and tenant two.I did replied the law suit on time But my wife didnt replied since she is not on the deed. Last friday they send a copy of letter that they sent to judge asking for default. I do want to pay the dues but i just want to buy some time. Am i in any jeopardy losing my house since my wife is not on deed. thankyou

Hello Umarh,

Membership in the homeowners association by a residential buyer is typically a condition of purchase; a buyer isn't given an option to reject it. Some homeowner associations hire and retain property management companies.

Hi Umarh!

Welcome to forums!

If your wife is not on the property deed, then they shouldn't have sent that notice to her. If you have replied to the notice on time, then they can't get a default judgment against you. I will suggest you to contact the HOA and check out if they are ready to negotiate with you regarding the payments.
