we have only recv'd mortage statements, but no legal papers, were ever served, and no posting on the property that the house is goint to sold at an auction.
what can i do, i have 3 kids, and a wife, i can move out in 3 days, that is impossible.

The lender has the rights to sell off the property at an auction if you're unable to pay off the loan. However, in order to do so, the lender has to send you the pre-foreclosure letter. If the lender has not done so, then he won't be able to proceed further in this regard. I would suggest you to speak to an attorney regarding this matter and take his help.
