My husband signed for a loan on equitment for a company. He did it in his name, but then a DBA also. He was never suppose to pay this debt. He signed for it and now the people quit paying. We gave the equitment back to the company, but now they are threatening to sue. We could have never affored the equitment in the first place. Could they take our home? Can I be sued I am not on the equitment deal? Could I just take my husband off of our house and then be safe? Help!!!!

Welcome to forums!

Taking him off from the property can be considered as an fraudulent activity by the lender. You'll not be sued as you are not on the deal. As your husband's name is on the loan, the lender has the right to sue your husband if the loan is not paid. I would suggest your husband to speak to the lender and check out if he can offer him any option to pay off the debts.
