Hi Brenda,

You can file lawsuit in court expression your intention to put lien on the property if the borrower fails to pay money within a certain time. Depending on the amount of the money involved, you can file the lawsuit in the small claims court. The court will look into your claim and will schedule a hearing. If you can prove your claim, the court will issue a judgment against the borrower asking him to pay the money within a given period of time. If the borrower still fails to pay you the money, you can file a lien against his property and get it recorded with the county recorder's office.
